Introduction:


At Oman ORIX Leasing Company SAOG (the Company) trust forms the basis of customer relationship. The Company is bound to honor the trust which customers place in the Company by choosing to deal with it and in return the Company treats the customer relationship with great care, particularly information that customers share with it. The Company firmly believes that customer privacy should not be compromised. At the same time, it is the Company's intent to provide customers a broad array of financial products and services that will help them attain their financial goals. Accordingly, the Company would like its customers to understand what information it gathers and how it is used.

1. Collection and Retention of Information:

The Company has always respected the privacy of customers and potential customers. It will continue to do so by treating information received from them as confidential and by handling it in accordance with local regulatory requirements and Company policy.

During the course of its activities the Company will collect, record and use information it receives in the form of lease applications, data provided by the Central Bank of Oman Statistical Bureau, customer authorized information obtained from third parties such as commercial banks and credit bureaus. The type of information collected will vary considerably depending on the nature of the financing arrangements to be provided by the Company. However, generally it may include personal information relating to the customer, which may include the following:


  • Name, address, telephone and such other contact details of the customer.
  • The customer’s date of birth;
  • The customer’s passport number/ ID number/ driving license particulars etc.
  • The customer’s employment and/ or business details.
  • Financial information pertaining to a customer.

  • The Company shall retain information pertaining to its customers for a period of at least 10 years as prescribed by the Central Bank of Oman. Any change in regulatory requirements in future would be a part of the Company's record retention practices.

    Further the Company shall restrict access to customer information to only those employees who need to use that information in the course of the Company's operations and their employment with the Company. The Company shall maintain physical, electronic, and procedural safeguards that comply with regulatory standards to guard customer information.

    2. Disclosure of Information:

    In the course of its business, it may be necessary for the Company to disclose customer information to external parties. However disclosure would be made only in any of the following circumstances:

  • When the customer gives its consent to the Company;
  • When the Company or others need to investigate or prevent a crime;
  • When the law permits or requires for a disclosure of confidential information to be     made, or any regulatory or
       governmental body requests, directs or requires for a     disclosure to be made, irrespective of whether or not the
       customer consents to the     same; or;
  • When there is a duty to the public to disclose any confidential information.
  • When it is required by the laws of the Sultanate of Oman and as instructed by the     Central Bank of Oman; or
  • At the general or specific request of the customer himself.

  • Any information relating to the customer which when received by the Company was at the time of its receipt a part of the public domain or subsequently became a part of the public domain, due to no fault of the Company shall not be deemed to be confidential information.

    In case of disclosure of customer information made under the laws of Oman, the customer will be informed promptly of such disclosure where permitted by law.

     
    3. Confidentiality of Information:

    The Company shall maintain high ethical standards while hiring staff and have sufficient screening procedures to provide reasonable assurance about the integrity of its employees. Additionally, the Company requires that all employees shall not disclose any confidential information which shall include data, computer programs, manuals, business plans, software, marketing plans, financial information, and other information disclosed or submitted, orally, in writing, or by any other media, to any other person unless it is duly authorized and wholly and exclusively in the course of business. This maintenance of confidentiality of information extends to past employees too. It also covers past and current directors of the Company.

    4. Monitoring

    The Company may monitor, record, store and use any telephone, e-mail or other electronic communications with a customer for retention purposes, so that the Company can verify any instructions given to it and to improve the quality of the Company's customer services.
     
    5. Protecting your privacy
     
    5.1 To the extent that sensitive personal data is processed in relation to a customer, the Company will employ appropriate security measures given the nature of such data. However, the customer recognizes that the use of the Company's Internet and website is entirely at the customer's own risk. The Company has through reasonable efforts endeavored to create a secure and reliable website for the users. However, the Company assumes no responsibility or liability for the security of personal information transmitted via the Internet.

    5.2 In the course of providing services to a customer, the Company may engage third parties to carry out certain services/operations on its behalf and transfer the customer's personal information to such third party. In doing so, the Company shall employ appropriate security measures to protect the customer's personal data where applicable.
     
    6. Accurate Information

    6.1 The Company may seek to verify the information provided to it by a customer and for such purposes share such information with fraud prevention agencies. In view of which, it is imperative that the customer provides the Company with accurate information. If the customer provides false or inaccurate data and the Company suspects fraud, it will provide such information to the concerned fraud prevention and/or regulatory agencies.

    6.2 The customer shall remain responsible for informing the Company of any personal details, which it may have provided earlier and where such information has subsequently undergone a change, so as to render the information available with the Company either inaccurate or incorrect, for example a change of customer's address or its title. The customer shall undertake to inform the Company, in writing, addressed to the Company's branch where the customer maintains its account, of any change to their personal information and data available with the Company, as soon as it is reasonably practicable in order for the Company to update its records. It must be noted that notification of any such change to a customer's personal information must be in writing, it should include the customer's account numbers with the Company.

    6.3 If the customer is of the view that its privacy has been breached by the Company then it must notify the Company of the same in writing immediately upon becoming aware of the same.
     
    7. Changes to Privacy Policy  

    Please note that this policy will be reviewed, and may change, from time to time. The revised policy will be posted to this page so that the Company's customers are always aware of the information the Company collects, how it uses such information and under what circumstances may it disclose such information.


    8. Limitation of Liability:

    Under no circumstances shall the Company or its employees or directors be liable for any direct or indirect, incidental, consequential, special or exemplary damages arising out of or in connection with use of this website, the use of any information contained herein, or use of any information in the Company's possession, whether or not the Company has been advised of the possibility of such damages, losses or expenses.
